AI Sex Chat 2026: What It Is and What the Law Allows

It’s a chat service where a language model plays a fictional character and agrees to move toward flirting and erotica with an adult user. You’ll also see “erotic AI,” “NSFW AI chat,” or “spicy AI”: these terms mean the same thing, with different intensity depending on the character and your settings.

In practice, you choose or create a character (look, personality, backstory), then chat by text. Depending on the app, generated images, voice messages, or short videos can be added, often for tokens, meaning credits bought on top of the subscription. The character doesn’t exist: it’s text produced on the fly by a model trained on large amounts of data.

Generally yes, for an adult chatting with a fictional adult character. Take France as an example: no French law prohibits an adult from having an erotic conversation with a program, any more than from reading an erotic novel.

What the law regulates is access by minors. In France, Article 227-24 of the Penal Code punishes making a pornographic message accessible to a minor, and the May 21, 2024 law known as “SREN” (securing and regulating the digital space) tasked Arcom, the French audiovisual and digital regulator, with a technical age verification standard for pornographic content services. Age checks for adult content are also spreading elsewhere. That’s why every reputable app asks you to confirm you’re 18, and some go further.

Three red lines apply whatever the app, and the terms of reputable services include all of them.

1. Any sexual content involving a minor. In France, Article 227-23 of the Penal Code punishes recording, distributing, or possessing pornographic images or representations of a minor. The word “representation” also covers drawn or generated content. Platforms therefore require characters who are explicitly adults.
2. Sexual deepfakes. A deepfake is AI-made content that imitates the face, body, or voice of a real person. In France, since the SREN law, Article 226-8-1 of the Penal Code punishes with two years in prison and a €60,000 fine making public or sharing with a third party sexual content generated by an algorithm that reproduces a person’s image or words without their consent. The penalty rises to three years and €75,000 when it’s published through an online service.
3. Identifiable real people. Even without sharing it, using a photo of an ex, a coworker, or a celebrity to generate an erotic character is banned by the apps’ terms and can violate image and privacy rights.

There’s no legitimate “hack” around these rules: platforms delete the accounts involved, and several say they report content involving minors to the authorities.

A reputable service shows itself by what it publishes, not by what it promises. Before creating an account, check five things.

• An identifiable publisher: company name and address in the legal notice or terms (for example EverAI Limited in Malta for Candy AI, Secret Labs Inc. in Delaware for Secrets AI).
• Written content rules: minimum age of 18, bans on minors and real people. A site bragging about having “no rules” is a red flag.
• Clear pricing: subscription, token costs, cancellation terms. Kupid AI’s terms, for example, mention $3.99/month for data retention after cancellation.
• A privacy policy you can read before signing up.
• Age verification, at least a self-declaration, sometimes more.

They’re stored on the publisher’s servers, like any message sent to a chatbot. An erotic conversation is intimate data: if it leaks or gets tied to your identity, the harm can be real.

2. Use a dedicated email, without your name, rather than signing in with Google or Apple.
3. Never send a photo of yourself or any information that could identify you.
